Legal Context in the US

In the United States, there’s no reasonable expectation of privacy in truly public spaces (streets, parks, sidewalks). Video surveillance (without audio in many cases) is generally legal for law enforcement and private parties in these areas.

  • The Fourth Amendment protects against unreasonable searches, but courts have upheld public CCTV as it doesn’t involve physical intrusion or hidden recording in private zones.
  • No comprehensive federal law strictly regulates public video surveillance, unlike wiretapping (Title III/ECPA). States vary on details like signage or data retention.
  • Facial recognition and AI: Increasingly used but controversial. Some cities/states have restrictions or moratoriums due to accuracy issues, bias, and privacy. Private companies (doorbell cams) feed into this ecosystem.
